Terms of Use
Scarlet Pictures
Effective date: October 18, 2026
Last updated: October 18, 2026
These Terms of Use (“Terms”) govern your use of the Scarlet Pictures website (the “Site”), operated by David May, doing business as Scarlet Pictures (“Scarlet Pictures,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
This is a practical document for a small creative portfolio. It is not legal advice.
1. What the Site is
The Site showcases David May’s films, video reels, screenplay catalog, and related creative work. It is for viewing and general information. It is not an offer to sell, license, or produce any work.
Contact: [email protected]
2. Ownership of the work
The films, videos, still images, screenplay titles and descriptions, text, and design on the Site are owned by David May / Scarlet Pictures or used with permission, and are protected by copyright and other laws. Cast, crew, music, and other contributors’ rights are respected as credited or licensed.
3. What you may do
You may watch the videos and browse the Site for personal, non-commercial viewing, and share links to Site pages or videos.
4. What you may not do
Without our prior written permission, you may not:
- Download, copy, re-upload, rebroadcast, or publicly screen any film, video, or still
- Use the work in festival programs, compilations, trailers, or advertising
- Edit, remix, or create derivative works from the films or screenplays
- Use any of the work, or anyone appearing in it, to train artificial intelligence models
- Scrape the Site, attempt to bypass security, or interfere with its operation
- Suggest an endorsement or affiliation with Scarlet Pictures that doesn’t exist
Brief quotation for commentary, criticism, news reporting, or review is fine, as allowed by fair use.
5. Licensing, screening, and festival requests
For screening, licensing, festival, distribution, or press requests, email [email protected]. Any permission must be in writing.
6. Screenplays and unsolicited submissions
We do not accept unsolicited creative submissions. Please do not send us unsolicited scripts, treatments, story ideas, or other creative materials. We may delete them unread. If you send them anyway, you agree that we are under no obligation to keep them confidential, to review them, or to pay you, and that sending them creates no relationship between us. This does not grant us any ownership of your work.
7. AI-generated content
Some work on the Site, including the videos at /ai, was made fully or partly with generative AI tools under David May’s direction. That work is labeled as AI-generated. Separately, some films and reels on the Site, including Itsy Bitsy, Fetch, and the 2007 Reel, were upscaled for picture quality with Topaz AI, an AI-based enhancement tool. Where that applies, the film’s page says so. Itsy Bitsy and Fetch were filmed and edited by David May without AI and are not AI-generated. Any resemblance of AI-generated characters to real people is not intended, unless a real person is identified with their permission.
8. YouTube and other third-party services
Videos are hosted on YouTube and play under the YouTube Terms of Service once you click play. Links to other sites, such as IMDb or Amazon, are provided for convenience. We are not responsible for third-party sites or services.
9. Festival, award, and credit information
Festival selections, awards, and credits are listed in good faith from our records. Festival names and marks belong to their owners and appear for identification only. They don’t imply endorsement.
10. Privacy
Our Privacy Policy explains how we handle information.
11. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. Some films may contain mature themes; viewer discretion is advised.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAVID MAY AND SCARLET PICTURES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW.
13. Indemnity
You agree to defend and indemnify David May and Scarlet Pictures against claims arising from your misuse of the Site or your violation of these Terms, to the extent permitted by law.
14. Copyright complaints
If you believe something on the Site infringes your copyright, email [email protected] with the work you believe is infringed, where it appears on the Site, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will review it and respond.
15. Governing law and venue
These Terms are governed by California law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, unless a law you can’t waive requires otherwise.
16. Changes
We may update these Terms by posting a new version with a new “Last updated” date. Continuing to use the Site means you accept the update.
17. Miscellaneous
If any part of these Terms is found unenforceable, the rest still applies. These Terms are the entire agreement between you and us about the Site. Any written license or agreement we sign with you for a specific work controls over these Terms for that work.
